(Part A: Identification of Statues)
Phoenix son of Name (?) . . . Andragoras son of Phoenix. Epikteta daughter of Grinnos. Kratesilochos son of Phoenix.
(Part B: Testament of Epikteta)
During the presidency of those associated with Phoiboteles, Epikteta daughter of Grinnos, acting with her guardian, Hypereides son of Thrasyleon, and with the consent of her daughter Epiteleia, being in sound mind and knowingly, has made the following will: While I am in good health and alive, I shall administer what belongs to me. But if I should die, I leave behind what is outlined here. This is done in accordance with the instructions given to me by my husband Phoinix. Phoinix also built the sanctuary of the Muses (Mouseion) for our deceased son, Kratesilochos and brought the statues and images of himself and of Kratesilochos and the heroic monuments. Phoinix also asked that I complete the construction of the sanctuary of the Muses and place the Muses, the images, and the heroic monuments there.
Two years later, after my only remaining son Andragoras died, Andragoras ordered that I complete the instructions of his father Phoinix and that I set up an image and a heroic monument for him (Andragoras), as for his father and his brother; that I establish a men’s association (koinon) consisting of relatives; and that I give to this men’s association three thousand drachmas as income, from the time that they are established. Therefore, since everything has been completed and established in accordance with those instructions, and the association of relatives has been established, whose names are subscribed, so that the association may assemble in the sanctuary of the Muses, I am giving three thousand drachmas to the previously indicated men’s association of relatives. These funds are owed on the lands that I own and acquired on my own in Melainai . . . when they inherit . . . I leave the sanctuary of the Muses and the sacred enclosure of the Heroon to my daughter Epiteleia, so that, when she has received the income of all of my possessions, she shall pay each year in the month of Eleusinios the sum of two hundred and ten drachmas to the men’s association of relatives.
No one shall have the authority to sell the sanctuary of the Muses, the sacred enclosure of heroic monuments, the statues that are in the sanctuary of the Muses or in the sacred enclosure of heroic monuments, or to mortgage, change, or remove them in any way at all, or to fabricate some pretext, or to build anything other than a stoa in the sacred enclosure. Nor can anyone use the sanctuary of the Muses except if one of Epiteleia’s relatives has a wedding. Otherwise, they shall be prevented by the association and the association shall have authority in whatever it does. No one shall have the authority to remove anything that is in the sanctuary of the Muses. If they do, they shall be prevented by the association of relatives, and the association shall have the right to prevent it.
Andragoras, the son of my daughter, shall hold the priesthood of the Muses and the heroic monuments. If he should suffer death, then the eldest of the family of Epiteleia shall be priest.
The men’s association of relatives shall assemble in the sanctuary of the Muses yearly in the month of Delphinios, receiving from my successors the two hundred and ten drachmas. For three days they shall designate one of them as the official, and shall sacrifice on the nineteenth of the month to the Muses; on the twentieth to the Heroes, Phoenix and Epikteta; and on the twenty-first to Kratesilochos and Andragoras. If Epiteleia or her successors do not pay the two hundred and ten drachmas in the month of Eleusinios to the men’s association of relatives, the produce of the previously indicated lands in Melainai shall belong to the men’s association of relatives, up to the value of two hundred and ten drachmas. If the successors prefer to give a security to the men’s association for the three thousand drachmas also on other lands, they shall have the authority to do this when they give secure mortgages.
Subscribed are the names of the relatives that have been assembled: Hypereides son of Thrasyleon; Antisthenes son of Isokles and, by adoption, of Grinnos; Aristodamos son of Isokles; Timesios son of Praxiteles; Euagoras son of Prokleidas; Prokleidas son of Euagoras; Kartidamas son of Proklidas; Hagnosthenes son of Kartidamas; Proklidas son of Alcimedon; Bolakrates son of Aglosthenes; Archinikos son of Gorgopas; Startophos son of Bolakrates; Gorgopas son of Archinikos; Gorgopas son of Echestratos; Gorgopas son of Kartidamas; Agathostratos son of Kratesilochos; Mollis son of Polymedes; Kartidamas, Kratesilochos, Dion, and Dorokleidas, sons of Agathostratos; Himertos son of Himerophon; Kritos son of Teisanor; and, Polynikos and Evagoras, sons of Soteles.
Also, the wives who live with them and their children shall be admitted, the female children as long as they are under parental authority, the males when they have reached the appropriate age, and their children under the same conditions. Also to be admitted are the women who have inherited from me, their husbands, and their children, under the same conditions as those noted above. Also to be admitted are my namesake Epikteta; my daughter Epiteleia; Mnaso and Ainesippa, the daughters of Gorgopas; Basilodika and Telisippa, the daughters of Thrasyleon; and Kallidika, the daughter of Isokles; and, their husbands. Also to be admitted are Epiteleia, daughter of Aristarchos, and her children.
Witnesses: Charon. . ., Euagoras son of Prokleidas, Antisthenes son of Isokles, who is also by adoption son of Grinnos.
(Part C: Regulation)
During the leadership of those associated with Himertos in the month of Diosthyos, Epikteta daughter of Grinnos, along with her guardian and husband of her daughter, Hypereides son of Thrasyleon, with the consent also of her daughter Epiteleia, has provided in her will three thousand drachmas for the purpose of sacrifice to the Muses and the heroes, and for a meeting (synagogē) of the men’s association of relatives, for which also it shall receive yearly from her descendants two hundred and ten drachmas, so that there shall be a meeting for three days in the sanctuary of the Muses. At the meeting, they shall prepare sacrifices for her husband Phoenix and herself, and her sons Kratesilochos and Andragoras. The one who becomes the official” (epimēnios; literally, “monthly official,” though the function by this time is no longer monthly) shall sacrifice on the first day to the Muses; on the second day to the heroes, Phoenix and Epikteta; and, on the third day to the heroes Kratesilochos and Andragoras.
For good fortune! It has been resolved to accept her (Epikteta’s) proposal and to hold the meeting after the first payment and, after the meal, to pour out all of the first cup as a libation for the Muses, Phoenix, Epikteta, Kratesilochos, and Andragoras. The meeting of the men’s association of relatives shall take place for three days yearly in the sanctuary of the Muses in the month of Delphinios. And all persons will freely provide service once, according to decending age. Likewise, their descendents, who enter the association after their departure from among the youths (ephebes), will first serve as official at their own expense. Those who serve as officials at their own expense shall provide imported wine, enough for three cups per person, one each for the crowning, the music, and the perfume. If anyone does not officiate according to what has been written, that person will pay to the association one hundred drachmas. This payment will be arranged by the administrator (artutēr) according to the laws. Now the one who violates what has been arranged in this regard will be excluded from the association until it has been paid.
During these years of free service, the administrator will collect the revenue due to the association during the meeting, and let it be applied to the loans secured for mortgaged properties, separating a deduction sufficient for the sacrifices to the Muses and to the heroes, according to the testament. He will also set aside no more than fifteen drachmas for entertainment during the meeting. If there is no longer a person that must provide the service without charge, all members will each take his turn, by rank of age, just as it is prescribed for those that undertake it freely. Ten days before the meeting is to take place, they shall receive from the administrator fifty drachmas. But if he does not serve after having received the money, let him pay one hundred and fifty drachmas, which the administrator will arrange, and let his property be seized as security, according to the law. Until it has been paid he shall not participate in the association. In this case, let the administrator serve as official and recover the cost first from the revenue. Let the banquet take place as the association decides and for the amount that it decides. If the administrator does not provide funds to the officials according to the regulations, let the official complete everything and offer the sacrifice for which he is responsible. But the administrator shall pay one hundred and fifty drachmas to the monthly officer he did not pay, and the right of execution on the debt shall lie with the one who did not receive the money and will be against the administrator, in accordance with a surety, in according with the law. And he shall not participate in the association until he pays.
Let the one serving as official on the first day offer to the Muses a victim and offerings consisting of cakes made with five measures (choinika) of wheat and a dry cheese costing one coin (stater). And also let him provide crowns for the gods and all the other things necessary for the entire sacrifice. And from these things he will set aside for the gods the customary parts from the victim that are sacred, and one cake. Let the one serving as official on the second day offer to the heroes Phoenix and Epikteta a victim and offerings, consisting of cakes made with five measures of wheat and a dry cheese costing one coin (stater). And also let him provide crowns for the heroes and all the other things necessary for the entire sacrifice. He will also prescribe the parts of the victim that are sacred, a cake, a loaf of bread, one cake and three fish. Let the one serving as official on the third day sacrifice in honor of the heroes, Kratesilochos and Andragoras, in the same manner as has been prescribed for Phoenix and Epikteta. When the officials offer these sacrifices, they will hand over to the associaiton all the cake and half of the entrails, and will keep the rest for themselves. The administrator will distribute the offerings to those present. If the monthly offering are made at the official’s expense, the supervisor (epissophos) who offers these sacrifices shall sell the remainder, in accordance with what is written. Whatever payment is received shall be disbursed by the administrator.
Let the association choose a supervisor. Let the one chosen convene a meeting annually on the second day of the festival and let him plan everything to do with the association, so that it shall be administered as it written in the testament and the law. Let him also record the official (epimēnios) and the administrator (artutēr) by age and the supervisor and the amount loaned. If anyone does not serve in his role as official or if anyone fails to do anything else that is his responsibility as prescribed in the law or the testament or the decisions of the association, he owes the penalty according to the law. Let him also record the income and expenditures made under his supervision and whether anything else is owed to the association. If he does not do what is specified, let him owe to the association three hundred drachmas, and he shall not participate in the association until he pays it. Let this be done by the men chosen by the association by way of seizure, according to the law.
Let the chosen administrator collect what is owing to the association according to the testament and all the other things assigned to him by the supervisor. Let him hand over to the official the amount prescribed in the law and also the amount collected for the sacrifices that was not spent, and anything else the association decides. Let him hand over the remainder to the meeting (syllogos). Now if he does not pay anything prescribed or the excess funds are not handed over to the meeting, let him owe to the association twice the amount he did not give. Also, let the supervisor record in the association’s record books the amount not paid as double the normal amount. And he shall be turned away from the association until he pays, and the right of implementation shall be with men chosen for seizure, according to the law. If he does not pay the monthly officials, the ruling shall be against him in accordance with what is written in the law.
In order that everything will be administered thoroughly according to the testament and the law and the decisions of the association for all time, and in case anyone should not act according to the law or the testament or the decisions, let the association strike a committee of elected men, however many they decide, which will ensure all things are done as decided by the association. Also let the supervisor write these things down. Now if the supervisor should choose not to write it, let the asssociation immediately appoint a man to write it down. Let the man chosen write all the things decided by the association.
Let whatever is decided by the majority of the association be considered authoritative except concerning dissolution. But concerning this let it not have authority either by oral or written request to dissolve the association or the prescribed sacrifices, or to do any harm to the association or create division or to malign anything traditional. Now if any such request is made orally or in writing, let the word or writing be invalid, and the one who spoke or wrote be expelled from the association and owe to it five hundred drachmas, and the right of execution shall be with men chosen by the association by way of seizure, according to the law, for all relatives who desire the same thing.
To ensure that the supervisor is approved and the one chosen writes down all things according to the law, let the meeting be convened by the leadership (ephorate) of Himertos in the month of Diosthyos and the supervisor shall be elected. Let this supervisor write down all the things according to the law, and also take care to ensure that the law and the testament are engraved and set up on the base of the statues in the sanctuary of the Muses, and are written on a writing tablet. The supervisor shall also provide a box in which the writings of the association are to be placed. Likewise the meeting will elect a male archivist (grammatophylax), who will receive an account from the supervisor, the writing tablet with the transcription of the law and the testament. He shall guard the box with the papyri in it for as long as the association decides. He will also bring them to the meeting. Now if the association should choose another archivist, he shall hand over these items to the one chosen after him in the meeting for reason of accountability.
