Lease Agreement for a Vineyard with Mention of an Agricultural Society (170 BCE) Philadelpheia - Fayum region

Philadelpheia (Fayum region, Egypt — Pleiades map), 170 BCE (November 12)
PRyl IV 583 = John S. Kloppenborg, The Tenants in the Vineyard: Ideology, Economics, and Agrarian Conflict in Jewish Palestine (WUNT 195; Tübingen: Mohr Siebeck, 2006) 471-474 (no. 37) = TM 5301  = ID# 20948

bibliography

Two fragments of a larger papyrus document (frag. i: 21 x 13.5 cm; frag. ii: 23 x 34 cm). Now in Manchester in the John Rylands Library (Gr. 583). The document includes two copies of the same lease agreement with very little difference between the copies. Only the first (aided in reconstruction by the second) is translated here. The translation below is heavily adapted with thorough revisions (by Kloppenborg and then by Harland) from that of Roberts and Turner (in PRyl). The lease agreement is included on this site because it makes reference to an "agricultural society (thiasos [see line 8 // 51]), presumably a guild formed by workers on the vineyard. This society is given a half jar of sweet wine within the terms of the agreement. The two Ptolemies and Kleopatra mentioned in the opening are the three children of Ptolemy V and Kleopatra I, who were associated as sovereigns in 170 BCE.

(fragment 1; copy 1 of the agreement)

In the first year of the reign of Ptolemy, Ptolemy his brother, and Kleopatra, children of Ptolemy (V) and Kleopatra (I), Manifest (Epiphaneis) gods, when the following were in office at Alexandria: the Alexandrian priest of Alexander, of the Savior (Soteres) gods, of the Brother and Sister gods, of the Benefactor gods, of the Father-loving (Philopatores) gods, of the Manifest gods, and of the Mother-loving (Philometores) gods; the prize-bearing priestess (athlophoros) of Bernice the Benefactor (Euergetis); the basket-bearing priestess (kanēphoros) of Arsinoe Philadelphos; and, the priestess of Arsinoe Philopator.  On Xandikos 9 which is Phaophi 9, at Philadelpheia in the Arsinoite district (nome).

Nikomachos son of . . . Name (Ph[. . .]ades) from Halikarnassos, successor to his father’s holdings, has leased to Apollonios son of Apollonios, Persian of descent, the somewhat sandy vineyard that belonged to Krates son of Pheidimos from Arsinoe in Lycia, wage-master (taktomisthos) of the Pamphylians in their command–a vineyard that is situated near the same Philadelpheia, measuring 6 arouras (an aroura was about 2735 metres squared) or whatever size it is–for the first year on the basis a one-third share of all fruit and produce that grow in this vineyard.

After all the fruit has been turned into wine, the distribution (apomoira) to the royal treasury has been deducted, the cost (misthos) for the treaders and the winepress has been paid, and a half a jar of wine has been contributed to the agricultural (geōrgikon) society (thiasos), the remaining sweet new wine (gleukos) shall be divided into three portions, with Nikomachos taking two portions and Apollonios taking one.  Each man shall provide his own jars as required for the distribution (apomoira) according to the proportions of his lease, and (10) each shall carry down the jars for himself to the winepress and carry up the sweet new wine for himself, while the distribution . . .  (about two and a half very fragmentary lines that refer to the winepress, to the royal treasury and to irrigation and guarding the fruit) . . .

Apollonios is to pay monthly wages from his own resources from the date stated above until the termination of the lease as seems best for the soil and the vineyard.  Apollonios is to prune the vine in a moderate and exact manner, to attend to the care of the young vines in a proper manner, to keep the ground of the property clear of weeds, rushes, reeds, quake grass, kinaios-reeds and all other types of tangling roots except for the dry ground within the . . . trench (?).   He should also remove the silt that is inside the trenches, keep the trenches dug and clear, and keep the property fenced in.  He is to clear out the drains and fence in the conduit that controls the water-flow near the (one or two missing words) . . . and lead it through for the irrigation.

When the lease has expired, he (Apollonios) is to return the ground of this property in clean condition, with the trenches clean as is presently stated.  If he fails to deliver it or to perform each of the tasks at the proper time, or if he abandons the lease, he is to pay the assessed wage, with a fifty percent surcharge for every task he fails to perform plus a fine of two silver talents for any damage that may be due at the time of his abandoning the lease.

(20) Apollonios is to shift fifty rows of vines to the uncultivated ground at his own expense and to transplant in the same year at the proper time. . . .

(The remaining lines 21-29 are quite fragmentary, dealing with a penalty of 1000 drachmas if Apollonios does not transplant as arranged; with the distribution of the “second wine” with two-thirds for Nikomachos and one-third for Apollonios; with the possible stationing of a guard for the vineyard with Apollonios paying the wages; and, with the shovel that Nikomachos lent to Apollonios and has to return, or face a penalty).

(Fragment 2, lines 42-82, contains a second copy of the lease in a third hand).
